I'm at a point where I'd like to move from sole proprietorship to LLC. However, provided that the FAA frowns upon any commercial aerial photography, would it even be beneficial to establish the LLC knowing that the protection of my assets might not be valid due to the FAA regs?

I'm glad that others share these views, as it does make a lot of sense, considering that the FAA has yet to complete any punitive disciplinary action, or collect an actual fine. Still, it seems wise to me to fly, both literally and metaphorically, under the FAA's radar. Unfortunately, this is exactly what led the backers of TacoCopter to withdraw their support at the last minute. Even though they had the legal resources to and the financial incentive to bring the FAA to task, they simply did not want trouble, period.
